A divorce legally ends a marriage. A divorce is called "dissolution" or "dissolution of
marriage." To get divorced, one person must file a document called a "petition or
complaint." The petition or complaint must be served on the Defendant (your spouse).
Your spouse may file a "response or answer." However, you and your spouse may
still reach an agreement.
An uncontested divorce means that the parties agree on all issues such as division of
property and debts, and alimony, child support and visitation if applicable. Every
settlement agreement or divorce decree must deal with five basic issues. These issues
deal with: Alimony, property division and if there are children, custody, visitation and
child support. These five issues must be determined by the divorcing couple in order
to obtain an uncontested divorce. If you and your spouse agree on everything and put
it in writing, you have an uncontested divorce; there is literally no contest.
The Peoples Choice provides a simple, convenient and affordable solution to your
estate planning document needs without compromising quality. We have reduced the
information gathering process to simple fill in the blank workbooks designed to
capture the information necessary to prepare your will or revocable living trust.
Perhaps the most important legal document you will ever sign. It goes into effect
upon your death and controls who gets your property, and who will manage your
estate and who will be the guardian of your children.
Living Trust: Single $399 Joint $449
Avoid having your major assets go through the probate process. Created while you
are alive, a Living Trust allows you to control the distribution of your estate. You
transfer ownership of your property and your assets into the trust although you
control the trust throughout your lifetime. At the time of death, a properly funded
trust owns the assets, not the deceased. The assets held in the living trust will avoid
the probate process.
Incorporation: Starting at $125
Incorporation means creating a new corporation. A corporation is an organization
that is approved by your state to conduct business. In the eyes of the law, a
corporation is a real person, it can sue and be sued.
Most people form corporations to protect personal assets because the owners of a
corporation are net personally responsible for the corporation's debts. This is called
"limited liability protection".
